WAIVER, RELEASE AND CONSENT TO TREATMENT

Massage, Esthetic Skin Care and Esthetic Scalp Health Treatments are not an exact science. Each individual will have a unique medical history and lifestyle, and there is no way to guarantee a specified result or freedom from adverse side effects. At Seven’s Heaven, you will always be treated by a licensed professional who will take all possible precautions to avoid any complications. It is therefore imperative that you disclose all of your information honestly and to the best of your ability so that your treatment can be tailored to help avoid complications. A failure to disclose pertinent information may result in unintended injury or adverse results.

Adverse side effects of esthetic skin care may include but are not limited to: swelling of the face, redness of the treated area, crusting of the skin, scars, infection, nicks, change of pigmentation of the skin, allergic reaction to the products used and stinging.

For Esthetic procedures: I understand this is a cosmetic procedure with risks and potential side effects, and I voluntarily wish to have the services provided with knowledge of the potential side effects. I understand that any false information I have provided may lead to undesirable consequences and affirm I have truthfully discussed my personal and medical history to my esthetician.

For Massage procedures: I understand that this is a procedure which involves manual manipulation of my body and its limbs. I understand that there could be potential side effects from stretching and/or deep pressure massage to my muscles. I state that I am choosing to receive these procedures of my own free will and with full knowledge of the possible side effects. Side effects of massage may include, but are not limited to: Swelling, irritation of the skin, soreness of the muscles, redness, aches, bruising, lightheadedness and  nausea. 

I further understand my failure to follow post-care instructions may also lead to undesired results, complications or effects. I understand that Seven’s Heaven and its estheticians/ massage therapists do not diagnose illness, disease, or any other physical or mental conditions. I hereby agree to waive and release any and all present and future claims, suits or related causes of action against Seven’s Heaven and its service providers. I further agree to indemnify and hold harmless Seven’s Heaven from any and all liabilities, claims, demands, expenses, damages, losses, causes of action, attorneys’ fees and costs of defense for, or on account of, death, personal injury, property damage and any other loss of any kind resulting from or related to my voluntary receipt of esthetic services and/or my breach of the terms and conditions of Seven’s Heaven.

I have read the above information and if I had any concerns, I have addressed them with my esthetician/Massage Therapist at Seven’s Heaven. I give permission to Seven’s Heaven to perform any and all of the procedures we have discussed, and will hold them harmless from any liability that may result from this treatment. I have given an accurate account of all known allergies or prescription drugs or products I am currently ingesting or using topically.

I understand that this waiver, release and consent will be kept on file and will apply to each and every service I receive today and in the future, and will have the same full force and legal effect every time I visit Seven’s Heaven. By signing this document, I state that I have read, agree and understand the terms herein and voluntarily have accepted the service and any potential risks that may be associated with the service.

I further represent that I am of lawful age and legally competent to sign this waiver, release and consent (or, if I am under 18 years old, I have directed my parent or legal guardian to sign on my behalf). I have carefully reviewed the information above and fully understand the terms and conditions. I understand that the terms herein are contractual and not a mere recital, and that I have signed this of my own free act, and with knowledge that I hereby agree to waive my legal rights.

The validity and interpretation of this waiver, release and consent shall be governed by the laws of the State of California. Any provision that is prohibited or unenforceable in California or in any other jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions, and any such prohibition or unenforceability in any jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction. I acknowledge that it is my intention to provide a release of claims to Seven’s Heaven to the fullest extent permitted by law.
